Waiver of NAESB Standards Allows Equitrans to Upgrade Software

On Aug. 8, 2017, Elizabeth Zerby, Acting Director of the Division of Pipeline Regulation in FERC’s Office of Energy Market Regulation, granted Equitrans L.P.’s request for a temporary waiver of certain North American Energy Standards Board (NAESB) Wholesale Gas Quadrant Version 3.0 business practice standards incorporated by FERC into its regulations in 2015.
“Equitrans states that it will be performing a computer software system upgrade from August 11, 2017 through August 13, 2017. Equitrans asserts that while the system is unavailable, Equitrans will provide information usually posted on the electronic bulletin board to its shippers by e-mail. Further, Equitrans asserts that it will be making reasonable accommodations to shippers’ needs during this period to provide for flexibility, and will waive any scheduling or imbalance penalties for any shipper imbalances that do not jeopardize system operation.”
Specifically, Zerby waived NEASB Standards 5.3.31 through 5.3.45 relating to handling of capacity release transactions, Standards 6.3.3 and 10.1.4 relating to trading partner agreements and data interchange, Standard 5.4.16 relating to System Wide Notices, and 18 C.F.R. §284.12 governing the standards for pipeline business operations and communications.
On Aug. 3, 2017, Equitrans updated its July 28, 2017 request to state that the estimated completion time of the upgrade is 6:00 am on Sunday, Aug. 13, 2017, rather than 1:00 am.
Zerby concluded that Equitrans’ demonstrated good cause for the requested waiver.
